2. Use of Sources and Data
We process personal data that we receive from our customers as part of our business relationship. In addition, we process - as far as necessary for the provision of our service - personal data that we legitimately gain from publicly available sources (e.g. commercial and association registers, press, internet) or that are passed on to us by other companies within the Buhck Group.
Relevant personal data are individual-related data (name, address and other contact data) and authentication data (e.g. signature). In addition, this may include data for the performance of contractual obligations, advertising and sales data, documentation data (e.g., mailed requests via e-mail traffic or contact form) and other data comparable to the above categories.
3. Purpose and Legal Basis of the Processing
We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG nF).
a) Contractual obligations (Article 6 §1b GDPR)
The processing of data takes place in the context of the execution of our contract business with our customers or for the execution of pre-contractual measures, which take place upon request. The purposes of data processing are primarily based on the specific assignment / order and may include, but is not limited to, needs analysis, consulting and the provision of informational communications. Further details on the data processing purposes can be found in the relevant contract documents and terms and conditions.
b) Balancing of Interests (Art. 6 § 1f GDPR)
Where necessary, we process your data beyond the actual fulfillment of the contract to protect the legitimate interests of ours or third parties. Examples:
- review and optimization of requirements analysis procedures for direct sales approach,
- advertising or market and opinion research, as long as you have not objected to the use of your data,
- asserting legal claims and defense in legal disputes,
- ensuring the IT security and IT operations of the company,
- prevention and investigation of criminal offenses,
- measures to improve sales performance through group-wide customer relationship management (business customers only)
- measures for the further development of services
c) Agreement (Art. 6 §1a GDPR)
Insofar as you have given us consent to the processing of personal data for specific purposes (e.g. receipt of newsletters), the legality of this processing is based on your consent. A given consent can be revoked at any time. This also applies to the revocation of declarations of consent, which were issued to us before the validity of the GDPR, i.e. before May 25, 2018. The revocation of consent does not affect the legality of the data processed until the revocation.
d) Legal Requirements (Art. 6 §1c GDPR) or in the Public Interest (Art. 6 §1e GDPR)
In addition, we are subject to various legal obligations, i.e. legal requirements (e.g. tax laws). The purposes of the processing include the fulfillment of tax control and reporting obligations.
4. Data Receiver
First of all, it is important to note that we are bound to secrecy about all customer-related data from which we gain knowledge. Within the organization, those entities gain access to your data, which they need to fulfill our contractual and legal obligations. Our service providers and vicarious agents may also receive data for these purposes if they comply with data protection agreements. These are companies in the categories of IT services, logistics, telecommunications, consulting as well as sales and marketing.
- Public bodies and institutions (e.g. tax authorities) in the presence of a legal or regulatory obligation.
- Other transport and disposal companies or comparable companies to which we transfer per-sonal data in order to carry out the business relationship with you (depending on the contract, e.g. container placement, disposal service, etc.).
- Other companies of the Buhck Group for controlling sales activities (only commercial customers).
5. Transmission of Data to a Third Country or to an International Organization
A transfer of data to offices in countries outside the European Union (so-called third countries) does not take place.
6. Duration of Data Storage
We process and store your personal information as long as it is necessary for the fulfillment of our contractual and legal obligations.
The data is regularly deleted if no longer required for the fulfillment of contractual or legal obligations, unless its temporary processing is necessary for the following purposes:
- Fulfillment of commercial and tax-related retention obligations: The Commercial Code (HGB), the Tax Code (AO) must be mentioned. The deadlines for storage and documentation are two to ten years.
- Preservation of evidence in the context of the legal statute of limitations. According to §§ 195ff. of the German Civil Code (BGB) these limitation periods can be up to 30 years, with the regular limitation period of 3 years.
7. Privacy Laws
If you have provided us with data, you have the right to obtain information pursuant to Article 15 GDPR (in conjunction with Section 34 Federal Data Protection Act (BDSG nF)), the right to correction pursuant to Article 16 GDPR, the right to cancellation under Article 17 GDPR (in conjunction with Section 35 Federal Data Protection Act (BDSG nF)) , the right of restriction of processing under Article 18 GDPR, the right of opposition under Article 21 GDPR and the right of data transferability under Article 20 GDPR. In addition, there is a right of appeal to a competent data protection supervisory authority (Article 77 DSGVO in conjunction with Section 19 Federal Data Protection Act (BDSG)).
You may revoke your consent to the processing of personal data at any time without giving any reason. This also applies to the revocation of declarations of consent that were given to us prior to the validity of the General Data Protection Regulation, i.e. before 25 May 2018. Please note that the revocation only applies to the future. Processing that took place before the revocation is not affected.
8. Obligation to Provide Data
In order to enter into or execute a contract with you, you must provide the personal information necessary to establish and conduct a business relationship and fulfill the related contractual obligations or to which we are legally required to collect. A business relationship is not possible if you do not provide us with the personal data.
9. Automated Decision-Making
In principle, we do not use fully automated decision-making pursuant to Article 22 GDPR for carrying out the business relationship. If we use these procedures in the future, we will inform you about this separately, if required by law.
10. Right of Objection according to Art. 21 GDPR
For reasons arising out of your particular situation, you have the right, at all times, to object the processing of personal data relating to you pursuant to Article 6 (1) (e) GDPR (Data Processing in the Public Interest) and Article 6 (1) (f) GDPR (Data processing on the basis of a balance of interests). This also applies to a profiling based on this provision (Article 4 No. 4 GDPR).
We will no longer process your personal data if you have objected. Unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing is for the purposes of asserting, exercising or defending legal claims.
In individual cases, we process your personal data in order to organize direct mail. You have the right to object, at any time, to the processing of personal data concerning you for the purpose of such advertising.
If you object to the processing for direct marketing purposes, we will no longer process your personal data for these purposes.

2. Automatic Storage of Data through our Website

This anonymous data is stored sepa-rately from any personal information that you may provide and so does not allow any conclusions to be drawn about a particular person.

7. Integration of fonts.com Fonts (Monotype)
Our website incorporates fonts from Monotype Imaging Holdings Inc. of Woburn, USA under the trademark fonts.com. When you visit our Web site, you connect to Monotype Imaging Holdings Inc. servers and submit your IP address for licensing and billing purposes.
The IP address will be saved by the provider for 30 days in a non-anonymised state. After this period the address will be deleted completely, so that no personalized data will remain stored.
